ACES IN PLACES Release of Liability, Waiver of Claims, Assumption of Risks, Indemnity Agreement & Terms and Conditions ("Release and Terms Agreement")
READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS
By participating in activities hosted by Aces in Places (“AIP”)—a mobile golf simulator experience operated by Aces in Places LLC of Reno, Nevada—you (“Participant”) acknowledge and agree to the terms outlined below. This agreement applies to you and any individuals (including minors) under your care or attending the event under your responsibility.
SECTION 1: RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT
I agree to observe and follow all posted rules, safety signage, and verbal instructions provided by AIP staff. AIP reserves the right to remove any participant who fails to follow safety guidance, without refund. I agree to follow all written and verbal instructions including but not limited to: hitting only from the designated striking area, respecting simulator safety barriers, and adhering to all safety protocols.
I certify that I am in good health and capable of participating safely in AIP activities. I understand participation carries inherent risks, including but not limited to:
Slips, trips, falls, or loss of balance (including from simulator platform or trailer entry)
Impact from golf balls or clubs
Contact with or misuse of simulator equipment or barriers
Equipment failure, simulator malfunction, or power outage
Reckless or intoxicated behavior by others
Inclement weather or Acts of Nature
Serious injury, illness, or, in rare cases, death
I assume full responsibility for these risks, including those arising from AIP’s negligence.
AIP’s trailer includes padded safety barriers designed to reduce impact. These are not load-bearing and must not be leaned on, pulled, or climbed. Misuse may result in removal and financial liability.
On behalf of myself and my heirs, I release and discharge AIP, its owners, staff, contractors, affiliates, and agents from all claims related to injury, damage, or loss. I agree to indemnify and hold harmless AIP from any legal claims, damages, or losses—including attorney’s fees—resulting from:
My actions or those of individuals under my care
Failure to follow rules or guidelines
Damage to AIP property or equipment
Third-party claims arising from my participation
SECTION 2: TERMS AND CONDITIONS OF SERVICE
Safety Rules & Participant Conduct
Rules apply to all participants. Failure to comply may result in removal without refund:
One golfer in the bay at a time.
Hit only from designated area.
Aim at screen. Intentional mis-hits prohibited.
No leaning/touching frame, curtains, or trailer walls.
No high-lofted wedges (max: pitching wedge).
No trick shots or reckless behavior.
No food/drinks/gum in simulator bay.
Children under 12 must be supervised.
Follow AIP staff instructions at all times.
Wear appropriate footwear (sneakers/golf shoes only).
Entering the trailer implies acceptance of this waiver. QR code posted onsite.
Booking & Payment Terms
Deposit Policy:
50% deposit due to book your date
Non-refundable deposit
Remaining balance due 7 days before event
Cancellation Policy:
14+ days out: full refund minus deposit
7–13 days: 50% refund beyond deposit
<7 days: 25% refund beyond deposit
Day-of or after arrival: no refund
Weather-Related: Rescheduling based on availability if weather prevents operation.
Travel, Setup & Access
Delivery/setup fees apply based on roundtrip mileage.
Minimum space: 36’ L x 16’ W x 16’ H
Flat, level surface required
Site must allow proper drainage & trailer clearance
Setup is 60–120 minutes prior to event
Unsafe/unprepared sites may lead to cancellation without refund
Equipment Damage Liability
Participants/hosts are financially liable for damage due to:
Unsafe or unapproved setup locations
Inadequate entry clearance or steep slopes
Failure to disclose access limitations
If AIP staff deems the site unsafe, event may be canceled with no refund.
Excessive Cleaning & Biohazards
Minimum $250 cleaning fee for spills, bodily fluids, or avoidable messes caused by neglect or intoxication.
Event Host Responsibilities
Proof of insurance may be required for high-risk or large-scale events. If not provided, AIP may cancel the event without refund.
Minors & Guests
You are fully responsible for individuals under your care. AIP is not liable for injuries due to failure to follow guidelines.
Media & Marketing Consent
By entering the trailer or interacting with AIP staff:
You grant AIP the right to photograph/record you and your guests
Footage may be used for marketing and promotion across all platforms
Applies to all attendees (participants, hosts, spectators)
Parents/guardians agree to these terms on behalf of minors.
Client Logo & Brand Usage
By booking, you grant AIP permission to use your name/logo in marketing materials (unless requested otherwise in writing).
Communication Consent
You agree to receive emails, texts, or calls related to your booking. You may opt out anytime.
Dispute Resolution
This agreement is governed by the laws of the State of Nevada. Any disputes shall be resolved through binding arbitration in Washoe County, NV, waiving the right to a jury trial.
