Release of Liability & Terms of Service

Aces in Places LLC Effective Date: April 11, 2026

PLEASE READ THIS DOCUMENT CAREFULLY. BY BOOKING A SESSION, PURCHASING A MEMBERSHIP, OR PARTICIPATING IN AN ACES IN PLACES EVENT, YOU ARE AGREEING TO BE LEGALLY BOUND BY THESE TERMS.

PART 1: RELEASE OF LIABILITY & ASSUMPTION OF RISK

1. Assumption of Risk

I understand that participating in mobile golf and multi-sport simulator activities involves inherent risks. These include, but are not limited to:

  • Being struck by a golf ball, golf club, or other sports equipment.

  • Physical exertion, slips, trips, or falls.

  • Injuries resulting from the proximity of other participants.

  • Equipment failure or malfunction.

I voluntarily assume all risks associated with my participation and the participation of any minors under my supervision.

2. Waiver and Release

I hereby release, waive, and discharge Aces in Places LLC, its owners (including Andrei Carnes), employees, and contractors from any and all liability, claims, or causes of action for personal injury, property damage, or wrongful death arising out of my participation in the Services, whether caused by negligence or otherwise.

3. Equipment Liability

I acknowledge that the ACE1 Trailer and Portable Bays contain high-value technology, including launch monitors, 4K screens, and specialized sensors. I agree to be financially responsible for any damage to Aces in Places equipment caused by:

  • Reckless or intentional behavior.

  • Failure to follow staff safety instructions.

  • Using unauthorized equipment (e.g., dirty golf balls or non-approved clubs).

  • Food or drink spills within the simulator area.

4. Media Release

I grant Aces in Places LLC the irrevocable right to use photographs and video recordings of my participation for promotional, marketing, and social media purposes without compensation or further approval.

PART 2: TERMS OF SERVICE & POLICIES

5. Booking & Cancellation Policy

  • Standard Rentals: A 50% deposit is required to secure your date.

  • Cancellations: * Full refund of deposit if cancelled at least 14 days prior to the event.

    • 50% refund of deposit if cancelled between 7 and 13 days prior.

    • Deposits are non-refundable if cancelled less than 7 days before the event.

  • Weather: In the event of extreme weather (lightning, high winds over 35mph) that makes outdoor operation unsafe, Aces in Places reserves the right to reschedule the event at no additional cost.

6. Membership Terms (The Founding 100)

  • Commitment: All membership tiers (Bogey, Par, Birdie, Ace) require a 3-month minimum commitment.

  • Billing: Membership dues are billed monthly via Stripe.

  • Rollover Policy: Unused monthly hours roll over for exactly one (1) month. A maximum cap of two months' worth of hours can be held in an account at any time.

  • Exclusions: Membership hours are for personal/private use and cannot be applied toward large-scale corporate events or weddings unless otherwise specified.

7. Code of Conduct & Safe Play

To ensure a premium and safe experience for everyone:

  • One Golfer at a Time: Only one person is permitted in the "hitting zone" at any time.

  • Attendant Authority: Participants must follow all instructions provided by the Aces in Places attendant.

  • Zero Tolerance: We reserve the right to terminate any session immediately without refund if participants are intoxicated, aggressive, or behaving in a way that endangers themselves or the equipment.

8. Service Area & Logistics

  • Our standard service area includes a 50-mile radius from Reno/Sparks.

  • Events outside this radius (including certain Lake Tahoe locations) are subject to a Travel Surcharge based on distance and vehicle accessibility.

  • Clients must ensure a flat, level surface with appropriate clearance (as specified on the ACE1 and Portable Bay pages) is available for setup.

9. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of Nevada.
